Welfare Benefit Plans (including Cafeteria Plans and Flexible Spending Account Arrangements)

In collaboration with our Health Care attorneys, our Employee Benefits attorneys assist our clients with the development of sound strategies for addressing the many legal issues and challenges arising from ERISA, HIPAA, COBRA, the ADA, Medicare, and other laws governing the health care industry and those that sponsor health plans.  We represent plan sponsors, financial institutions, health organizations, trade associations, and other clients in all phases of the documentation process for compliance with IRS requirements for active employee health, retiree medical, dependent care and health care flexible spending account arrangements, Health Savings Accounts, and Health Reimbursement Accounts.

We recently drafted a “wrap” plan document for an employer who wished to consolidate several welfare benefit plans into a single document. We also helped a large employer draft required notices, plan provisions, and contract language regarding HIPAA privacy, transactions, and security compliance requirements.  We also have experience working with employers to structure and establish disease management or wellness programs to encourage healthier lifestyles and cut health care costs.
